Proposal for a regulation amending Regulation (EU) No 910/2014 (eIDAS) as regards establishing a framework for a European Digital Identity 2021/0136(COD)
General overview
The aim of eIDAS2 is to create a single European Digital Identity which will be available to EU citizens residents and businesses who want to identify themselves or provide confirmation of certain personal information.
eIDAS2 seeks to address the shortcomings of the existing eIDAS Regulation (EU) 910/2014 (which established a necessary framework to enable mutually recognised electronic identification and signature services in the different Member States).
To achieve the single European Digital Identity (EDI), each EU citizen and resident will be able to use a European Digital Identity Wallet (EDIW). EDIWs will be issued individually by Member States. eIDAS2 requires Member States to issue at least one EDIW within 24 months of the entry into force of the regulation.
eIDAS2 will build upon the scope of eIDAS and extend the remit to electronic archiving services, electronic ledgers, management of remote electronic signature devices and the creation of electronic stamps.
eIDAS2 inserts a new article 51 into eIDAS1 (Regulation 910/2014). eIDAS2 will apply on a phased basis as follows:
1. Secure signature creation devices shall continue to be considered to be qualified electronic signature creation devices until 21 May 2027.
2. Qualified certificates issued to natural persons shall continue to be considered as qualified certificates for electronic signatures until 21 May 2026.
3. The management of remote qualified electronic signature and seal creation devices by qualified trust service providers may be carried out without the need to obtain the qualified status for the provision of these management services until 21 May 2026.
4. Qualified trust service providers that have been granted their qualified status under this Regulation before 20 May 2024 shall submit a conformity assessment report to the supervisory body proving compliance as soon as possible and in any event by 21 May 2026.
