General overview
The Data Governance Act (DGA) creates a framework to facilitate the sharing of personal and non-personal data across the EU.
Specifically the DGA lays down the conditions for the re-use in the EU of certain categories of data held by public sector bodies. For example, health data gathered by public bodies might be leveraged to improve personalised treatments or research.
The DGA sets out a notification and supervisory framework for the provision of data intermediation services, which aim to provide a secure environment for organisations or individuals to access information. For organisations those services will help them fulfil legal obligations regarding data sharing.
The DGA also seeks to facilitate “data altruism” by providing a framework for the voluntary registration of entities which collect and process data made available for altruistic purposes.
A group of experts consisting of representatives from various EU entities (the European Data Innovation Board) will also be established under the DGA in order to advise and assist the Commission.
Status
Regulation applies across the EU since 24 September 2023
Entities that were providing data intermediation services (Article 10) on 23 June 2022 must comply with the obligations in Chapter III (Articles 10-15) by 24 September 2025
