Proposal for a regulation on harmonised rules on fair access to and use of data 2022/0047(COD)
General overview
The Data Act establishes a harmonised framework for sharing industrial, personal and non-personal data in the EU. It aims to unlock the untapped value of data and implement a single market in data in order to foster data-driven innovation and will ensure fairness in how the value of data is allocated among actors who are active on different levels of the value chain.
The Regulation includes measures to:
- provide product users (both business and consumers, )who generate data through the use of connected devices, with transparency rights to gain a further understanding of the types and volume of data collected by products or services used by them
- provide product users (both business and consumers) with rights of access to self-generated data and to share such data with third parties sto use their data for aftermarket and other value-added services
- provide for public sector bodies to access and use data held by the private sector that is required in exceptional circumstances, such as a public emergency
- allow customers to more easily switch between different data processing providers.
Status
Regulation applies, in the main, across the EU from 12 September 2025
Article 3(1) (obligation to make product data and related service data accessible to the user) applies from 12 September 2026
