Proposal for a regulation laying down harmonised rules on AI 2021/0106(COD)
General overview
The EU Artificial Intelligence Act (AI Act) aims to foster the development of a single market of safe and lawful AI and to ensure the use of AI protects public interests and respects fundamental rights. It also strengthens the effectiveness of existing rights and remedies as applicable to AI systems.
To this end, the proposal for the AI Act intends to regulate AI systems through implementing a risk-based approach. Certain AI practices will be entirely prohibited, such as those which materially distort human behaviour or evaluate individuals in order to develop a social score.
AI systems which are classified as "high-risk" will be subject to the highest level of regulation. High-risk AI systems and their operators
will be subject to various requirements and obligations relating to transparency, governance, dataset specification, risk management, human oversight, record keeping, incident notification and registration among others. AI systems which are not classified as high-risk may still be subject to transparency and other obligations. The latest draft of the Act will also create a specific framework which is applicable to generative AI systems.
A new European Artificial Intelligence Board will be responsible for issuing recommendations and opinions. Enforcement will begin at a national level, with a high level of cooperation and information sharing between Member States and the European Commission envisaged.
